These terms apply to your use of divotend.com and to any order you place with us. The site is run by divotEND Scotland Ltd, company number SC394060, registered office 5 South Charlotte Street, Edinburgh EH2 4AN ("divotEND", "we", "us"). By using the site or placing an order, you agree to these terms.
1. Orders
When you order, you'll receive an email confirming we've received it. Our contract with you is formed when we dispatch your order. If we can't accept or fulfil an order, we'll tell you as soon as possible and refund anything you've paid.
2. Prices and payment
Prices are in pounds sterling (£) and include VAT. Delivery charges are shown at checkout. Payment is taken when you place your order. If a product is shown at the wrong price by mistake, we'll contact you before dispatch and you can cancel for a full refund.
3. Delivery
We deliver within the UK. Free GB delivery applies to orders over £30, including all Club Box orders. Full details are on our Shipping page.
4. The 30-Day Fair Play Guarantee
Smart Mats and tees bought direct from divotend.com can be returned within 30 days for a refund of the price paid, with return postage at your cost. Club Box orders are excluded. Full details are on our Returns page.
5. Your right to cancel
If you're a consumer, you can cancel your order within 14 days of delivery for a full refund, under the Consumer Contracts Regulations 2013. The guarantee above is in addition to this right.
6. Faulty goods
If anything arrives faulty, we'll replace it or refund you, whichever you prefer, and cover the return postage. This doesn't affect your statutory rights.
7. Business customers
If you buy for business purposes – including golf clubs and pro shops buying Club Boxes – the consumer rights in sections 5 and 6 don't apply in the same way, and our total liability is limited to the price you paid for the goods concerned.
8. Resale
Our products may not be resold online through any channel other than those licensed by divotEND Scotland Ltd. Unauthorised online resale may give rise to a claim for damages.
9. Using this website
The content of this site is for general information and may change without notice. All text, images, designs and logos belong to or are licensed to divotEND and may not be reproduced without our permission. Smart Mat® is a registered trademark. Links to other websites are provided for convenience only and don't mean we endorse them.
10. Liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't legally be limited. Otherwise, we're not liable for losses that weren't reasonably foreseeable when you placed your order.
11. Privacy
How we use your personal information is explained in our Privacy Policy.
12. Governing law
These terms are governed by the law of Scotland. If you're a consumer living elsewhere in the UK, you can also bring proceedings in your home courts and rely on the mandatory consumer protections of your part of the UK.
13. Changes
We may update these terms from time to time. The version on this page when you place your order applies to that order.
